Chandigarh: Almost a month after the
Haryana government gave an undertaking to the Punjab and Haryana high court not to be swayed by any recommendations by state home minister Anil Vij for suspension of the Hisar DSP for allegedly failing to act on his directions, the officer has been placed under suspension.
Claiming the state’s decision as against the July 5 orders passed by the HC, suspended DSP Rohtash Singh has now approached the court for revocation of government’s orders.
According to the officer, on August 9, despite the fact that the petition filed by him has been disposed of in terms of the judgment rendered in the case of Saroj Bala and another, he has been suspended by the additional chief secretary (home).
“No show cause notice or opportunity of hearing was granted to the petitioner before passing the impugned order,” his petition states.
On June 9, Vij, while presiding over a meeting of district public relations and grievance committee in Hisar, had recommended the officer’s suspension for not taking action in a case ordered by him. Rohtash had immediately challenged the minister’s recommendation before the high court.
Hearing his plea on July 5, the Haryana government had given an undertaking that it would not be swayed by any recommendation made by Vij in this matter. After that, the HC disposed of the matter.
However, on August 9, the additional chief secretary (home) had released the suspension order of Rohtash (57), a resident of Haryana’s Bhiwani district.
In his fresh petition, which is expected to come up for hearing this week, the suspended cop has contended that the district public relations and grievance committee, Hisar, is not a statutory committee. “In this meeting held on June 9, verbal orders were passed by Anil Vij, as chairman of the committee, to place him under suspension. The petitioner was not called in the meeting to explain his position at any point of time,” the petition states.
