Apple Reuse & Recycling Program

Apple Inc., or any of its affiliates or subsidiaries (collectively, “Apple”) provides this recycling and reuse service (the “Service”) at no cost to you (“You”). To the extent permitted by applicable law, Apple hereby disclaims and excludes any and all warranties of any kind, express or implied related to the Service. 

Apple is providing the Service only for Apple or non-Apple branded electronic devices that are of the same type sold by Apple Retail or Apple Online stores(i.e. devices that contain microchips or circuit boards and are designed and commonly used for personal or household use together with accessories that are used with such devices (“Devices”).  The following items (including their components and accessories) are ineligible as Devices under the Service: appliances, motor vehicles and other mobility devices, medical devices (other than monitoring devices), and devices with substantial contamination or liquid content including those that ordinarily would be expected to come into contact with bodily fluids.  Apple reserves the right to reject any device based on its nature, condition, or other factors.

You represent and warrant that You have the lawful right to allow Apple or its designee to perform the Service. You represent that You are providing to Apple or a location designated by Apple, only Device(s) that are owned by You or others in your household and were used exclusively or primarily for personal purposes.  If You send or bring in Device(s) owned by others in the household, You have been authorized by such owner to send or bring in the Device(s).

Once You send a Device(s) to the location designated by Apple or bring a Device to an Apple store for the Service, you transfer title in such Device to Apple and disclaim any further right, title or interest in and to the Device or any data contained therein. 

If the Device is being brought to an Apple Retail store for the Service, You represent that You are a resident of the State in which the Device is being brought for the Service.

Apple cannot, and does not guarantee, that it will be able to honor any request for return of the Device once submitted. You agree that You have the sole responsibility to keep a separate back up copy of any files or data before transferring ownership of the Device to Apple. Data recovery is not a part of the Service and Apple accepts no responsibility or liability for any lost files or data. 

Any items given to Apple as part of this Service must not violate any applicable laws, including export laws and You represent and warrant that You have  and shall comply with any and all such laws. You represent and warrant that any items You provide to Apple as part of this Service shall not: (1) infringe on any third-party intellectual property right (including copyright, trademarks, patent, trade secrets or other proprietary right) or (2) be counterfeit, stolen, or fraudulent. 

This Service is provided for lawful purposes only, and You agree to indemnify Apple and any of its directors, officers, employees, affiliates, subsidiaries or agents from and against any claims brought against any of them arising from performing this Service on customer’s behalf or for any breach of these terms and conditions by You.   

Apple and its affiliates, employees and agents will under no circumstances be liable for any special, indirect, incidental or consequential damages resulting from this Service. 

To the extent permitted by applicable law, Apple’s entire liability, if any, from any cause whatsoever with respect to this Service shall not exceed $20. 

This offer is void where prohibited or restricted by law. Apple reserves the right to change these terms and conditions or to cancel this Service at any time without notice. 

This Service is not redeemable and has no cash value.
