Tobacco Usage

• In FY2010 Delaware spent $10.8 million on tobacco prevention, which is 77.5% of the CDC
Annual Spending Target.1

• The CDC estimates that 50.2% of adult smokers in Delaware tried to quit smoking in 2008.2

• Delaware received $169 million in tobacco settlement payments and taxes in FY2010.3

• Delaware has not securitized any of its Master Settlement Agreement (MSA) dollars.4

State Tobacco Laws9

Excise Tax: There is a tax of $1.60 per pack on cigarettes, as of July 31, 2009. Moist snuff is
taxed $0.54 per ounce. All other tobacco products are taxed 15% of the wholesale price.10

Clean Indoor Air Ordinances


• Smoking is prohibited in all child care centers, government buildings, health facilities,
restaurants, bars, schools and private workplaces.

Youth Access Laws


• The minimum age requirement for the purchase of tobacco products is 18, and penalties
exist for both minors and merchants who violate this law.

• Establishments are required to post signs stating that sales to minors are prohibited.

• Only sales clerks are allowed access to tobacco products prior to sale.
