You will submit the assignment as an individual written report and both the parts of the assignment
must be answered. You need to follow a formal business style of writing with single spacing and font size
12. The work done should be properly formalized, the use of Harvard referencing should be done. You
have to also provide a bibliography using the Harvard referencing system. The advised word limit is from
4000-4500 but there is not penalty if you exceed this limit. Plagiarism should not be more than 15%.

Context and Scenario:
Scenario 1 (LO1 & LO2)
You have recently been appointed as the Jr. Law Associate at Legal and Legal Co. A new manufacturing
business approached the firm to develop a system for handling the business’s legal matters. Since the
manufacturing business is expanding and transforming into a larger unit, the company did not previously
have any legal department and requires a detailed approach towards successful development of such a
supporting structure to take care of any legal issues. You have volunteered to lead the team that will
work on this assignment. Before agreeing to allow you to lead, the firm wants to assess your technical
and knowledge expertise for the project at hand.
In the layman terms, explain (P1):
a) The purpose of any legal system, and how is effects the business environment as well as
its possible applications.
b) The comparisons between both the criminal law and civil law, the court structures within
your jurisdiction and explain the role of each court present within the system. (P2)
c) Sources that constitute formation of legal system along with differences and impact of
various laws relating to contract law, data protection act & competition law.
Evaluate the effectiveness of the legal system in terms of recent reforms and developments. (M1)
Secondly, the firm also wants you to develop a presentation on all the laws applicable on the
current manufacturing concern, detailing the legalities to be aware of while considering
stakeholders such as the consumers and employees. (P3)

Provide a coherent and critical evaluation of the legal system and law, with evidence drawn from a

Scenario (LO3)
As mentioned earlier, the manufacturing concern is growing with the passage of time. The directors of
the business are starting to consider taking the next step towards growth; formation of a company.
You are required to relay the legalities of all types of business models including their legal
structures, classifications, registration requirements.(P4)
Advise on the processes needed to be adopted relating to the management of the company
after its formation and should include different modes for liquidating the company. (P5)

Scenario (LO4)
The main reason for the manufacturing concern to approach the business was to seek advice regarding a
possible law suit plan and hire the firm against a law suit being currently faced.
1. One of the employees of the company has sued the business claiming wrongful dismissal. Ex-
employee is claiming being dismissed on the basis of her gender and as a ‘retaliation’ tactic
because she launched a campaign among her fellow employees seeking equal pay rights for
females working the same jobs as men whereas the employer claims on dismissing the
concerned employee on the basis of breach of contract terms including but not limited to
intentionally damaging business assets. This has also resulted in a dispute among the directors
of the company regarding the decision taken to handle the situation.
2. The directors are also looking to sue a supplier that has not honored the contract terms by
delivering the items late to the manufacturing concern, resulting in the loss of a major contract
that was dependent upon the timely delivery of the items. The manufacturing concern has no
use for the items anymore because of not securing the dependent contract bearing the entire
loss of the project. Supplier is adamant on full payment of the items but the manufacturing
concern wants to claim the damage done as a result of late delivery by the supplier.
You are required to provide legal guidance to the manufacturing concern regarding the
issues at hand suggesting appropriate legal solutions with proper justifications.
You are also required to advise on other areas of dispute among employment and various
other areas such as commercial property, corporate and commercial dispute that could arise
in the future so that strategies are developed proactively to deal with any such mishap in
the future. (P6)

Before providing legal advice to the manufacturing concern on the abovementioned issues you decide to
take one of your subordinates along for their experience. However, the criterion of selection of that
