ARTICLE 2. TITLE AND SCOPE OF CODE
This code shall be known as the “CHILD AND YOUTH
WELFARE CODE”. It shall apply to persons below
twenty-one years of age except those emancipated
in accordance with law. “CHILD” or “MINOR” or
“YOUTH” as used in this code shall refer to such
persons.

Every child is endowed with the dignity and worth of a human
being from the moment of his conception, as generally accepted in
medical parlance, and has, therefore, the right to be born well.

“The Special Protection of Children against Child Abuse.”
This acts directs the formulation of a comprehensive program for the protection of
children against child prostitution and other sexual abuse, child trafficking, obscene
publications and indecent shows and other acts of abuse and circumstances which
endanger child survival and normal development.

“An Act Prohibiting the Employment of Children Below 15 Years of Age
This act prohibits the hiring of children as workers in whatever establishment and in
whatever form.

Act Establishing a Comprehensive Juvenile Justice and Welfare System.
This act signed on May 15, 2006, exempts children 18 years old and below from
criminal liability.

Child Protection Policy (DepEd Order No. 40, s. 2012)


“An Act Prohibiting the Employment of Children Below 15 Years of Age
a. DepEd shall ensure that schools are a safe place for the education of children. The best
interest of the child shall be the paramount consideration in all decisions and actions involving
children.
b. DepEd’s zero tolerance policy for any act of child abuse, exploitation, violence, discrimination,
bullying and other forms of abuse.

Convention on the Rights of the Child 1989.
The Convention is the most widely ratified human rights treaty in history. It has
inspired governments to change laws and policies and make investments so that more
children finally get the health care and nutrition they need to survive and develop, and
there are stronger safeguards in place to protect children from violence and
exploitation. It has also enabled more children to have their voices heard and
participate in their societies.
