Unit Transfer AGREEMENT

This agreement transfers the allotment of a flat from one block to another block in a residential development called Shri Sadhna Dham. Specifically: 1. The allottee was originally allotted a flat in Meera Tower but requested to transfer to a flat in Shyama Block. 2. All monetary payments for the original flat will be applied to the new flat. 3. The allottee takes responsibility for all payments and liabilities regarding the new flat.

Unit Transfer AGREEMENT

This Agreement is made of this 8th day of July 8, 2023 at Vrindavan, Mathura (U.P.)
between:-

1. M/S Shri Sadhna Developers, a partnership firm having its registered office at
G-2/86, Sector 15, Rohini, Delhi --- 110085 and acting through its authorized
signatory (hereinafter referred to as the "First Party" which expression, unless
repugnant to the context or meaning thereof, shall be deemed to mean and include
its assignees, nominees, successors) of the FIRST PART.
AND

2. Sh. ___________________________________ S/o ______________________


R/o _________________________________________________________
(hereinafter referred to as the "Allottee, which expression shall, unless repugnant to
the meaning or context herein, be deemed to mean and include his/her/its
authorized representatives, nominees, administrators, successors-in-interest,
executors, permitted assigns, etc) of the SECOND PART.

The Party of the FIRST PART is the owner of a under construction flats (Radha &
Shyama Tower) & under planning (Meera Tower) built on land parcel admeasuring
3,280 sq. mtrs. Located in Khasra No. 211,212 & 213 Mauja - Chattikara, Tehsil &
District - Mathura Utter Pradesh ("Land") having a project under the name and style
of 'Shri Sadhna Dham'

Whereas Sh./Smt. __________________________________________________ S/o,


W/o, D/o ____________________________ was allotted Flat No. _______________
in Meera Tower of Shri Sadhna Dham, vide Allotment Letter No. __________ Dated
_________.
And whereas on the request of party of SECOND PART the above said dwelling unit
was further transferred by the M/S Shri Sadhna Developers vide letter No.
____________ Dated ________ in the name of Sh.
__________________________________ S/o _________________ on the basis of
availability to Flat No. ________ in Shyama Block of Shri Sadhn Dham

And whereas the M/S Shri Sadhna Developers has conceded to his/her request on
the terms and conditions hereinafter appearing.

NOW THEREFORE THIS AGREEMENT WITNESSETH AS UNDER:

1. That the All monetary payments made by the allottee in relation to Flat No. _____
of Meera Block in Shri Sadhna Dham shall be deemed as a constituent part of the
payment made towards the newly allocated Flat No. _______ of Shyama Block in
Shri Sadhna Dham

2. That the Allottee shall be liable and responsible to the M/S Shri Sadhna
Developers for all the payments, dues and other liabilities concerning the allotment
of Flat No. ____________ in Shyama Block of Shri Sadhna Dham, which is being
transferred in the name of the Allottee.

3. That the Allottee shall abide by the provisions of the M/S Shri Sadhna Developers
and Rules and Regulations made thereunder, and The terms and conditions subject
to which the dwelling unit was to be allotted or which may be imposed by the M/S
Shri Sadhna Developers from time to time.

4. That the Allottee shall execute and sign all papers, documents, agreements and
contracts etc., which the M/S Shri Sadhna Developers may require to be executed or
signed by him/her from time to time.

5. That in the event the Allottee fails to perform or comply with any of the terms and
conditions of this agreement, the M/S Shri Sadhna Developers shall be empowered
to cancel the allotment of said dwelling unit and may also forfeit the whole or part of
the amount paid to the M/S Shri Sadhna Developers till the date of such cancellation
and the amount so forfeited shall be deemed to be the reasonable compensation to
be applied to the M/S Sri Sadhna Developers for its absolute use without reference
to any damage or loss actually sustained.

6. That if any dispute or differences of opinion arises regarding interpretation of the


wordings of Clause of this instruments, the M/S Shri Sadhna Developers shall take
the decision in this regard and such decision shall be final and binding on the parties.

In witness whereof the M/S Shri Sadhna Developers and the Allottee set their hands
on the Agreement on the day, month and year first above mentioned in the
presence of the following:-
