A RESOLUTION ALLOWING THE CITY MAYOR THROUGH THE
VALENZUELA CITY TRANSPORTATION OFFICE (VCTO) TO PROVIDE
ANOTHER AMNESTY TO THE REMAINING REVOKED/CANCELLED
TRICYCLE FRANCHISE OF EXISTING BONAFIDE MEMBERS OF TRICYCLE
OPERATORS DRIVER’S ASSOCIATION (TODA) IN VALENZUELA CITY
UNTIL THE END OF SEPTEMBER OF 2023.

WHEREAS, Section 30 of Ordinance No. 1028 Series of 2022 provides
that non-renewal of franchise and Motorized Tricycle Operators Permit (MTOP)
for two (2) consecutive years shall mean automatic cancellation and revocation
of the same;
WHEREAS, pursuant to SP Resolution No. 497 Series of 2014 or “A
Resolution authorizing the City Mayor through the Valenzuela City
Transportation Office (VCTO) to renew revoked/cancelled tricycle franchise of
existing bonafide members of Tricycle Operators Driver’s Association (TODA) in
Valenzuela City”, the VCTO has issued a deadline for registration until
December 31, 2014 for the extension of the amnesty of revoked Public
Tricycles. However, there are still some owners of revoked franchise who failed
to register on time due to lack of financial capability to process their
documents or other circumstances that hindered them to register at the VCTO
which prompted the Sangguniang Panlungsod to enact SP Resolution No. 1314
Series of 2019 extending the period for the renewal of revoked/cancelled
franchise of Public Tricycle for hire until September 2019;
WHEREAS, despite the final extension given in SP resolution No. 1314
Series of 2019 there are still a clamor from several TODA for the remaining
revoked franchise in their respective associations who still failed to register
their franchise due to the COVID 19 pandemic crisis that our country has
experienced from 2020 until now and for lack of financial capability to process
the same;
WHEREAS, in the interest of economic stability for the livelihood of
tricycle for hire of drivers in Valenzuela City, the Sangguniang Panglungsod
decided to give another extension for registration to the remaining revoked
franchise of public tricycles for hire until October 31, 2023 subject to the
procedures and condition of the Sangguniang Panlungsod and the Valenzuela
City Transportation Office (VCTO);
NOW, THEREFORE, be it RESOLVED as it is hereby RESOLVED by the
Sangguniang Panlungsod ng Valenzuela to authorize the Honorable
WESLIE T. GATCHALIAN, in his capacity as the City Mayor of Valenzuela
through the Valenzuela City Transportation Office, to grant amnesty to
revoked/cancelled tricycle franchise of existing bonafide members of tricycle
operator’s driver’s association (TODA) in Valenzuela City until the end of
October of 2023.
RESOLVED FURTHER, the Honorable City Mayor is also authorized to
perform the following powers and functions:
SECTION 1. TITLE – This Executive Order shall be known as the “THE
AMNESTY PROGRAM OF REVOKED/CANCELLED TRICYCLE FRANCHISE OF
2023”.
SECTION 2. PURPOSE – The purpose of this Resolution is to expedite
the grant of franchise to all the existing bonafide TODA Members included in
the TODA Master list submitted before the Valenzuela City Transportation
Office (VCTO), whose franchise has been revoked/cancelled by reason of non-
renewal of the same within the period provided in the Ordinance.
SECTION 3. OBJECTIVE – It is within the duty of the City Government
of Valenzuela to provide public commuters an organized and disciplined
transport sectors to guarantee their protection and safety in everyday
transportation. In like manner, the City Government is likewise mandated to
help its constituents, find a decent means of livelihood to provide their family
financial support and basic needs that would grow and strengthen their ties as
a basic social institution.
SECTION 4. APPLICATION/LIMITATION – The provision of this
Resolution applies and is limited only to those existing bonafide/legitimate
TODA members who were included in TODA Master List submitted before the
VCTO. For this purpose, a certification under oath that the applicant or party
is a bonafide legitimate TODA member issued by the concerned TODA shall be
required. The Amnesty Program, as provided herein, is effective until October
31, 2023.
SECTION 5. PROCEDURES FOR THE ISSUANCE OF FRANCHISE TO
LISTED TODA MEMBERS CERTIFIED AS SUCH BY THE CONCERNED
TODA. –
a. The Valenzuela City Transportation Office (VCTO) in coordination
with the Public Information Office (PIO) shall disseminate this
amnesty in all Tricycle Operators and Drivers Association (TODA)
in Valenzuela City to see to it that all TODA members whose
franchise has been cancelled/revoked from 2018 until 2020, may
apply for the renewal of their revoked tricycle franchise.
b. A bonafide TODA member intending to renew their franchise is
required to secure first a Certification under oath from the TODA
President certifying to the effect that he/she is a bonafide TODA
member and that his/her name is among those listed in the TODA
master list previously submitted in the Office of the VCTO.
c. The applicant shall then proceed to the VCTO Office to submit the
said certification with duly accomplished franchise application
form to be provided by the said Office. Pertinent documents that
may be required by the VCTO shall be attached.
d. The VCTO shall then make proper assessment and verification on
the information made in the application form and other pertinent
documents submitted by the applicant and shall thereafter issue
the corresponding renewal of franchise unit upon determination
and declaration of “no disqualification” and after payment of
required fees, penalties and other charges as may be imposed by
the VCTO.
e. If the last renewal of the revoked franchise fall and shall be
revoked in the year 2018, the renewal of franchise shall be
considered, but not those franchises revoked prior to the year
2018.
f. This rule shall apply to all revoked public utility tricycles with
franchise and shall only be allowed upon submission of a proper
petition to the Board to determine the due authenticity and
veracity of documents that will be submitted to the Valenzuela City
Transportation Office.
g. Considering that the grant of a tricycle franchise is not a right but
a privilege being granted to an individual by the City Government
of Valenzuela, all revoked franchise and permits that are allowed to
be renewed at the VCTO are barred from selling and placing the
franchise or permit for mortgage or any encumbrances but can be
transferred by way of DONATION or WAIVER AND TRANSFER OF
RIGHTS or by way of a “LIPAT KARAPATAN” to immediate relatives
only who are actually residents of Valenzuela City and must
execute an undertaking thereof;
SECTION 6. SEPARABILITY CLAUSE – In the event that any part or
provision of the Resolution shall be held invalid, the other part or provision
hereto which are not affected thereby shall continue to be in full force and
effect.
SECTION 7. EFFECTIVITY – This Resolution shall take effect upon
signing hereof.
