Introduction
The diary gives the detail of the internship program with
Advocate Mr. Varun Kumar Gupta under whose guidance, I have
completed my internship . It was a great learning experience for
me. The internship gave me the opportunity to have an insight
the judicial system and its working. I visited District and Session
Court Lucknow Qaiserbagh , where I got an opportunity to
observe court proceedings.
It was a valuable insight into the actual working of courts and
lawyers. I was able to learn about working of lawyer’s office,
study of case files of running as well as old cases which are in
proceeding.
It was a rich experience of working of courts and our judicial
system and the role of lawyers in delivery of justice.

DAILY REPORT
DAY 1
Entry 1
Place:- District and Session Court, Qaiserbagh, Lucknow
Couse of Events:
At around 9:45 AM I reached at Session and District Court,
Qaiserbagh, Lucknow , U.P for my internship with Advocate Mr.
Varun Kumar Gupta . His chamber is located at gate no 4 of
session court . I went to the chamber I introduced myself to Sir
and his associates. Sir told me about the rules and regulations,
proper decorum that is needed to follow in the court premises
and court room especially. He told what to do and what not to
do in the court room . He asked me about my future plans and
so I told.
Sir introduced me to his clerical assistant and told me that if I
have any doubt, I can ask him about the doubt. Later , I tagged
along with him , and I was shown the copy branch of the court
as well as the filling office. Later I went along with the junior
advocates which have already been working in that office and
went to notary office with them. After a while all of us
came back to the chamber office.

Observation and learning:
In the chamber Advocate sir asked the junior to prepare a
bail bond / Surety bond for a client.
The format was printed with the help of the office laptop
the name and amount were put. The amount was 50,000 so
with that copy of registry documents of a vehicle with
estimate value on insurance more than that of 50,000 and
identity proof were attached to it.
This application was to signed by two sureties and once it
was done the same was taken by junior for applying in the
court for further process.
DAY 2

Place: Chamber Gate no 4 , District and Session Court ,
Qaiserbagh , Lucknow, U.P.
Observation and Learning:
In the morning each occupant of the chamber had some
task to do. So , I as an intern assisted them with the tasks

and learned the way of working of the office during a busy
day.
Juniors were busy getting the exemptions prepared and
applying them in the courts.
I observed that a ticket is to be stamped on the application
and it acted as the court fee. Such ticket was dated with pen
with date on which it applied.
Advocate sir was busy preparing the cross for a case for set
today.
After some time, I went along with Advocate sir to the court
room on third floor.
Entry 4
Place: Court of Rajdeep Singh , Additional Chief Judicial
Magistrate, Courtroom no 32 , District and Session Court

It was a matter of threat and grievous hurt for which the victim
is present in the court and giving his statement.

Observations:
Before entering the Coutroom Advocate sir checked the
cause list on the outer wall of the courtroom in which the
case listed for today .
After checking the list Sir entered in the room and reached
before the sitting Judge .
Defendant advocate is also here they talks about the fact of
the case .
After some discussion Hon’ble Judge gave another date for
further proceeding.

After that we went to the chamber of the sir for general
proceedings of that day.
Day 3

Place: Court of Mr. Hrishikesh Pandey , Chief Judicial Magistrate
Court room no 22 Second floor, District and Session Court ,
Qaiserbagh, Lucknow.

Observation and learning:

In this case I found that there is a F.I.R which is finally
disposed by the police by submitting the F.R report to the
Court.
Court had send the summon to the complainant asking
whether the complainant is satisfied or not.
As complainant wanted advocate sir plead for turning the
F.I.R in to the complaint.
Advocate sir told me that re-investigation should be
ordered in the case as he thinks.
After that Advocate sir went to some other necessary
proceedings.

I went to the other court room with his juniors . Where junior
told me that in every court ,room which is concerned with the
criminal matters ,there will be a policeman of related police
station called “Pahrokar”.
All of such policemans maintaining the diary of theirs police
station.

Place: Gate no 4 District and Session Court Qaiserbagh Lucknow.
Observation and Learning:
In the chamber a client entered who had been in contact with
Advocate Sir and came to the office as directed.
Sir asked the junior to take out a copy of ‘’ Vakalatnama”from
the cabinet.
The client was asked to sign the vakaltnaama and at the same
time his identity proof’s were being photocopied.
After that some payment was given by the client in cash and
he was assured that his work would be done . After this when
the client asked to leave for some other work Advocate sir let
him go.
Day 5

Place: Nakal Karyalaya Second floor , District and Session Court
, Qaiserbagh , Lucknow.

Advocate Sir said to junior to take copy of some important
document from Nakal Karyalaya for his case Ramsingh vs
Satendra singh.
We went to the nakal karyalaya with the application which is
stamped with some tickets along with required fees(10rs). After
that they said to collect the required certified copy day after
tomorrow in working hour.
That day is not as busy as usual .After sometime Advocate sir had
another personal work so he went too early.

Place : Gate no4 , District and Session Court , Qaiserbagh,
Lucknow.
Observations and learning:
I reached the court early as usual just because I did not want
to miss out any learning opportunity and get the most
productivity out of it.
When advocate sir reached , we altogether enetered the
chamber and shortly after that went to the court complex.

Sir gave me some files to hold as walked through the
corridor and asked to hand over different files time to time.
The clients was waiting for advocate sir in his chamber to
meet him .
Day 7
Entry 10
Place: C -2112,C block Indira Nagar , Lucknow -226016
Today sir called me and directed me to come his chamber
which is located at Indira Nagar, Lucknow.
Observation and learning:
I reached early and waited for sir to arrive , once
advocate sir got there, we entered the chamber.
Sir carried some files with himself which he placed on
the table, I asked sir and took a file folder to read.
When I was done reading sir asked me to write down an
application for exemption .
Sir told me about exemption and why it is needed.
Once done writing the application , I handed it over to
sir then sir told me that in what way exemption
application should be written.

After that sir write a application and stamped it . he sent
me to the courtroom to apply with his juniors.
Day 8
Entry 11
Place: Chamber , District and Session Court , Qaiserbagh,
Lucknow
Observation and learning:
As I reached our chamber it came to my knowledge that for
one of the matters set for today, the parties were directed
to mediation by the court.
So, I along with a junior went to the mediation centre which
was located at the first floor of Court Complex.
We were just supposed to check if the parties showed up
for mediation and after mediation process escort out client
to the chamber.
After that sir told me the procedure of BAIL . Sir told me that bail
should be applied in lower court. As a general practice it has
been seen that lower court usually dismiss the bail. Then the
person who is behind the bar go for a appeal in District Court. If

bail is dismissed by the DJ then appeal can be made in High
Court.
If a person is behind the bar and the police report has not been
submitted with in 90 days of filling the F.I.R . then the person
who is imprisoned has right to got the bail.This type of bail is
called the default bail. In CrPC bail is given under Sec 439 .

Place :Chamber Gate no 4 District and Session Court,Qaiserbagh
, Lucknow.
Observation and learning:
As I entered to the chamber , Sir is busy in drafting some
application with the help of his juniors.
Later sir told me that this is application of Sec 156(3) Of
CrPC,1973.
He told me that when a complaint is not being registered
by the local police . later this complaint is referred to the
Supreintendent of Police as per sec 154(3).After all of that

if the victim is not being heard he can complaint regarding
the event happened to him.
He can file a application before the magistrate whether to
order the local police to lodge a F.I.R or to file as a
complaint.
After filing the application to the court , court sought for
counter to the police. After that the court can order to
police whether to lodge F.I.R or to investigation.
Day 10

Place : Court Complex , District and Session Court, Qaiserbagh ,
Lucknow.
Observation and learning:
When I was on our way to the chamber , I received a call
from the munshi , and we were asked to attend to a client
standing in front of a courtroom.
Sir gave me the work of checking the list sticked outside the
courtroom.
Also , I was asked to inform if our case has come up, so that
advocate sir would reach there when required.

As the man standing out of the courtroom called the name
of parties I inform my senior that our case has been
soughted.
Day 11

Place : Court Complex , District and Session Court , Qaiserbagh
, Lucknow .
Observation :
As I entered to the gate no 4 and walked some steps I met
my seniors who are junior of Advocate sir. They told me
that today is strike.
I asked them for what purpose strike is going on. They said
that when all of the advocates have some problem about
the office or other proceeding of system.
Today strike was held for the purpose to relocate the office
of court no 8 which is currently very far from the court and
advocates are facing problem to go again and again to the
ground floor.
They all are sitting on the carpet lying on the floor.
After that I went to the chamber and later on I went to
home as no proceeding was going on.

Issue of the case:
It is a case of dishonor of cheque due to insufficiency of
funds and till now the complainant has not received its
payment.
Facts of the case :

Mukesh Kumar Tiwari gave his money 72100 rs cash
as lander to Nitin Talwar in lieu of his car which is
registered to his wife name Richa Talwar.
After completion of the period of the borrowing
amount Nitin Talwar came to Mukesh Kumar Tiwari
and gave him 2100 Rs cash and a cheque of UCO
Banko of remaining amount Rs 70000.
Mukesh Kumar Tiwari applied it to his bank account (
Bank of Baroda) he came to know that cheque is
dishonoured because of insufficient funds .
Mukesh kumar Tiwari went to his advocate and send
him a legal notice regarding the payment of money
within 15 days . If not done a case will be filled against
him.
After such notice Nitin Talwar ignored the notice and
Mukesh Kumar Tiwari filled a suit by his Advocate .
The case is being heard in court room 25 of Hon’ble
Judge Farha Jameel.

Facts-
A girl named Muskan D/o Murli is going to her home meanwhile
a men named Arun Rajput S/o Ramprasad stopped in her way ,
teased her and pulled her chunni. At that same time the girl’s
brother came from behind and opposed him to not to do so .
Arun also beated her brother who is saving his sister. This event
date is 15/06/2021
Her father get to the police station and give an application
regarding the above mentioned event. Police officer made a
complaint against Arun Rajput.
At the time of event girl’s age is 16 years as per her certificate of
matriculation.
So the F.I.R lodged in POCSO Act , in this act police officer has to
be arrest the accused and after that start investigation.
After 6 days Arun has been arrested by the police and sent to the
jail.
As Arun had been sent to the jail he applied for bail to the POCSO
Court , and bail is accepted by the court .

Later police file a chargesheet under section 169 of CrPC in which
police found that Arun is Guilty of that offence.
A trial is going on the court.

CONCLUSION
Summarising it all, I would like to deliver the message that
the real legal practice is completely different from the
theoretical version of law which we learn about through
books. Without exposure to the actual working of the
profession, one cannot gain the experience that is required
to progress in his field and attain success. Through books
we get the body of law, practice of law gives it the soul
required to run that body.
I was amazed to see how lawyers can use the law to their
benefit and their opposition by drafting turn the case
around using the same law . I also observed that law is
constantly developing and changing as per the applicably.
This internship helped me expand the horizons of my
knowledge and happy I chose to spend my time in court
trying to learn as much as I can while avoiding wasting my
time on the other things that can wait in life. Cause if I
master this early on life, I would be given the opportunity
to do the other things and in a better way.
