After three years in the making, a draft of the United Nations Convention Against Cybercrime was agreed upon in August, with a focus on advancements in technology, how its used to commit various acts of cybercrime, from fraud to child sexual abuse, and how to combat it. “The U.N. obviously thinks about things in this global perspective and … I think fundamentally, the convention is aimed at increasing international cooperation, which is absolutely critical to combat cybercrime just as it was sort of international drug trafficking,” said Alexander Southwell, partner at McDermott Will & Emery. While the convention could be a big step toward a global consensus on cybercrime, numerous political and human rights organizations have urged states to vote against adopting and implementing the treaty, because of several controversial clauses concerning human rights and jurisdiction. For instance, Article 22, which discusses jurisdiction, grants states the authority to regulate cybercrime actions taken outside of their borders that cause injury to their citizens, also known as passive personality jurisdiction. Some believe that Article 22 could put the free speech rights at risk by allowing foreign governments to target and surveil foreign journalists and activists. “To be frank about it, the United States does have extraterritorial jurisdictional effects of [certain] laws … we try to charge and arrest people in foreign countries for effects on the United States,” Southwell said. “Criminalizing journalists' activity, criminalizing ways of life, criminalizing lots of different things … opens up a somewhat dangerous risk of encouraging more sort of extraterritorial reach of what we Americans would think of as problematic … but of course it wouldn't be viewed as problematic by the powers that be in certain repressive governments.” Full story from Ella Sherman: https://lnkd.in/esnQAYWB

Law firm failures are never pretty but St. Louis-based Armstrong Teasdale's failed foray into Europe is a cautionary tale. Just three years after setting up shop and moving to London's leafy Lincoln’s Inn Field, AT found itself swimming in troubled waters. So far, bankruptcy administrators have only collected a fraction of the £512,040 the firm is owed for legal work. Another £495,600 in the bank was frozen by administrators.
