BCSBI code of Banks' Commitment to customers is Customer Service 8.0
228 applicable to… Micro and small enterprises
What are the areas of concerns due to implementation Customer Service 8.0 Areas of concerns due to implementation of provisions of FATCA i) The implementation of provisions of FATCA
of provisions of FATCA? are in the nature of fulfilment of country’s international obligation and noncompliance can lead to huge
penalties in addition to loss of reputation. ii) In case of non-compliance or wrong compliance with the
provisions of FATCA, SBI may be treated as a Non Participating Financial Institution (NPFI) by US IRS. Once any
Financial Institution is treated as NPFI, a 30% withholding tax would be applicable for all payments made
through such non participating financial institutions. This would only lead to no one transacting or holding
account with such Non participating financial institutions, as all the transactions would result in 30% levy and
229 the account holders would receive only 70% of the funds due. This can lead to losing all business with a US
connect. iii) It is imperative that the operating staff understand and appreciate that inadequate/incorrect
reporting would lead to a host of operational risk issues. Gaps or laxity in observing due diligence procedure
from the prescribed rules would amount to non-compliance risk and would subject the Bank to reputation risk
with concomitant penalties. iv) Also customer acquisition and business sourcing would get adversely affected if
the frontline staff is not able to convince properly the need for additional information from existing and
prospective customers. v) As FATCA due diligence is not a one-time exercise but a continuous exercise, due
seriousness and high level monitoring is required in the FIs.
