Vocational Scenario or It is your first month as a trainee solicitor at Wildings


Context Solicitors in Birmingham and the company has been
overwhelmed with a lot of cases from a variety of clients. Your
manager is confident that you will be able to identify the legal
criteria for offer and acceptance in a valid contract and has
assigned you to give the client advice on the prospect of
building a case ‘Marcus Hardy VS Vodafone 2020’, on
whether or not he would be able to take legal action or not.

Prospective Case - Marcus Hardy VS Vodafone 2020.

On Wednesday, 1st August 2020, Marcus Hardy saw several


TV advertisements for a new iPhone X. In one of the
advertisements, Marcus noted the company - Vodafone
displayed the package: ‘a brand-new iPhone X, 300
minutes of Vodafone to Vodafone call, 500 text
messages to any network and 10 GB of data for £35 a
month.’

The next day Marcus went to Vodafone’s store located in New


Square, West Bromwich and was greeted by the Customer
Service Assistant, Samantha. Marcus informed Samantha of
the advertisement, Samantha did not review the
advertisement properly, but told Marcus that he could get
‘300 minutes across all networks, not only to Vodafone’.
Marcus immediately requested a contract form and further
asked Samantha to permit him to take it home in order that he
could read the written terms and conditions. He also informed
her that he would return to the store with his decision.

At home, Marcus decided that he should draft his own


contract, which stipulated the terms and conditions that he

would like.

On Friday 3rd August, 2020 Marcus returned to the store with


the copy of the contract he wrote. He informed Samantha that
he wanted to purchase the new iPhone X. She was happy that
Marcus decided to return and make the purchase; she then
informed him that he would be required to sign the company’s
pre-written contract to which Marcus agreed and signed. He
also signed his own written contract for his own records, but
the company was not aware of this.

On 3rd of September 2020, Marcus received a bill of £155.00


from Vodafone. Marcus was extremely angry and informed his
older brother about the situation. His older brother phoned
Vodafone’s customer services, but they refused to speak to
him, as he was not involved in the contract.

The next day, Marcus went to the store and requested to


speak to the Store Manager who reviewed his account. The
manager explained to Marcus that he has used 200 minutes
out of the allotted 300 calling other networks, and also that he
has used 3 GB of data outside his allowance.

Marcus informed the manager that Samantha told him that he


would be able to use 300 minutes across all networks. He
further told the manager that he wrote his own contract which
included a term which allowed him to use 5 GB of data for £10.

Marcus knew that he would find it difficult to pay the £155


reflecting on his status as a 2nd year university student.
Vodafone on the other hand was not admitting to making any
error nor offered to reduce his bill; Marcus realised that he
needed to seek legal advice.

In Microsoft word, you might prepare a report that identifies


and explains when (and therefore how) the contract chosen
would come into existence.

An extension to your report was required by your manager to
demonstrate your knowledge of misrepresentation in
contracts. You were required to show:
o an application of the law on misrepresentation to a
given situation in relation to the formation of contract
Task 2 so that the types of misrepresentation can be explored
in the context of an everyday contract.

In your report, discuss the possible examples of


misrepresentation in Marcus’ and Vodaphone contracts. (You
can also choose other contracts to explain how the
misrepresentation will affect the contract.
