  This arrest was conducted by the Southeast Special Project Team (SESPT) who work in
a plain clothed capacity, operating discreet vehicles. The mandate of the team is to
proactively target crime and disorder and persons involved in stolen property, fraud,
violence or other criminal offences within Southeast Division.
 
On July 19, 2019 at 2100hrs Miranda KILPATRICK's White Ford F150 truck was broken
into while parked at the Superstore at 4950 137 ave (EPS file 19­105466). KILPATRICK's
wallet with personal information and keys to other vehicle, a Green 2019 Jeep Wrangler
were stolen.
 
On July 20, 2019 at 0649hrs KILPATRICK awoke to find her Green 2019 Jeep Wrangler,
valued at $60,000 missing from its parking spot at 10955 84 st. Using tracking data the
vehicle was located in a complex at 524 Lee Ridge Road. The plate now displayed was
M64303 belonging to Toyota on the Trail. (The plate was not registered to any vehicle
which is common and well known for dealership plates which makes it a common target
for stolen vehicles).  Surveillance was established and at 1016hrs Shannon KERR and
Wesley GRIST walked slowly towards the Jeep. GRIST was leading the way with KERR
walking behind as though scanning the parking lot. GRIST had the keys and fobbed the
vehicle unlocked loading 2 bags into the vehicle. KERR entered the driver's seat and
GRIST entered the passenger seat.
 
The Jeep was followed to 11606 103Ave where GRIST exited the passenger seat and
opened the hood and began pulling out fuses, likely attempting to locate the on star
tracking device. A removed fuse was found on the ground next to the Jeep. At approx
1105hrs both were taken into custody. Upon arrest when KERR was advised she was
under arrest for theft of auto given the recency of the theft, KERR stated she didn't steal
the Jeep because the keys were stolen from the owner's F150 (which is accurate).
Toyota on the trail confirmed the licence plate M64303 (value $80) had been stolen
overnight.
 
A post arrest search of KERR's phone which was in the vehicle, showed a text message
sent at 1102hrs (minutes before her arrest) on this date stating "u known anybody for
VINS or chopping, I got a brand new 2019 Jeep Sahara". The last internet search on her
phone listed "how can I disable a vehicle tracker". Upon post arrest of the 2 backpacks
loaded by GRIST, a switchblade knife was located. The initial plate of BFC9811 which
had been on the Jeep upon theft and a second licence plate which had been stolen
along with the Jeep keys were not located in their belongings.
 
KERR was found to have a Bylaw form 7 warrant. Both were transported and lodged in
cells.

parked near the co­accused's address and they entered the vehicle together driving
downtown where the AC exited and was removing fuses from the vehicle looking for the GPS
tracking fuse. In his backpack a switchblade was located.

INVESTIGATIONS:
 
1. On 19JUL20 I was working in a plain clothes capacity as a member of the southeast
special project team. I was A/sgt for the team when Cst. WEAVELL heard a broadcast for a
stolen vehicle being tracked to the area of 66 st and 34 ave. We were dispatched to the event
0651hrs. The vehicle stolen was a 2019 Green Jeep Wrangler (BFC9811) valued at $60,000.
The vehicle was located parked in a visitor parking stall in the area of 524 Lee Ridge Road.
The plate now attached to the vehicle was M64303 which was shown registered to a
numbered company determined to be Toyota on the Trail. Cst. WEAVELL contacted Toyota
on the Trail and confirmed that the plate had been lent out to a customer for a ford Flex who
was to return it on July 19 however had since determined the plate to have been stolen from
his flex. The licence plate M64303 was entered as stolen on CPIC at that time.
 
2. Surveillance was established and at 1016hrs a male carrying 2 backpacks walked towards
the Jeep followed by a female who was trailing behind scanning the parking lot. The male,
later identified as GRIST, Wesley had the key and fobbed his way into the vehicle. The
female, KERR, Shannon followed behind and entered the driver's seat. After sitting stationary
for a few minutes the Jeep departed and was followed downtown. The Jeep parked in behind
an apartment building at 11606 103 ave. GRIST exited the driver's seat and was working
under the hood of the Jeep, KERR still in the driver's seat. Canine member Cst. LEACHMAN
assisted us in pinching in the vehicle from the rear. Cst. MACDIARMID took GRIST into
custody and Cst. WEAVELL and Cst. BERTOLOZZI took KERR into custody at approx
1105hrs.
 
3. It was determined GRIST had been removing fuses likely looking for the GPS device. Upon
arrest a cellphone was on the driver's seat where KERR had just exited. A text message, sent
at 1102hrs was sent from the phone to a Tara stating "U know anybody for VINs or chopping.
I got a brand new 2019 Jeep Sahara 2000K". The last internet search was "how can I disable
a vehicle tracker".
 
4. Both were identified and determined that KERR had a Form 7 bylaw warrant. KERR and
GRIST were transported back to SE division with the assistance of patrol. The vehicle
recovered before it was able to be listed on CPIC. The plate was removed from CPIC by Cst.
WEAVELL. Cst. WEAVELL returned the Licence plate to Toyota.
 
5. KERR claimed she had not stolen the Jeep however did stated that the keys were stolen
from a ford F150 in the north end (which was accurate). The Jeep had been stolen overnight
and surveillance had been set up at approx 0700hrs parked near her residence from where
she was seen walking towards the vehicle. Cst. BERTOLOZZI contacted the Superstore from
where the Ford F150 had been parked when the keys were stolen however the theft was not

captured on video.
 
6. The owner of the vehicle, Miranda KILPATRICK attended the area to retrieve her Jeep. Her
initial licence plate of BFC9811 was not recovered. The other items also belonging to
KILPATRICK taken from the Ford F150 were not recovered.
 
7. KERR's cellphone was seized as it contained evidence of her knowledge the vehicle was
stolen and her intent to re­vin or sell it. GRIST's property was searched and his switchblade
located in his backpack was seized and submitted as evidence. KERR was provided multiple
opportunities to use the phone room upon return to SE division. Cst. WEAVELL chartered
and cautioned KERR while Cst. PATTEN chartered and cautioned GRIST.
 
8. KERR was issued a No insurance ticket and both were issued notice of intentions relating
to the theft of the motor vehicle. KERR and GRIST were lodged in cells.

Police Witness Statement
 
INVESTIGATIONS:

1.  On 19JUL20 I was assigned to the Southeast Special Project Team (SESPT) working in a
plain clothes capacity and operating a covert police vehicle.  At 0701hrs the SESPT was
dispatched to a report of a theft of motor vehicle.  Call comments were that RE:
KILPATRICK, Miranda had called reporting her 2019 green JEEP WRANGLER with AB
plate BFC9811 stolen and that it's GPS was showing NW of 34 AVE NW and 66 ST NW.
2.  Reg.#3415 Cst. PATTEN advised that he had located and confirmed the vehicle by VIN
and that it was now bearing AB plate M64303.  Surveillance was established and
maintained as Cst. PATTEN stated that a female had entered the driver seat and a male
into the front passenger seat.
3.  Surveillance was maintained until the JEEP parked behind 11606 103 AVE NW.  As I
approached the JEEP i saw the male passenger (AC: GRIST, Welsey) had the hood and
fuse box open and was looking closely at the fuses.  GRIST was holding tissue as though
not to leave fingerprints (the fuse box was very clean, this wasn't to keep his hands
clean). I also observed the female driver (AC: KERR, Shannon) was still sitting in the
driver seat.
4.  At 1105hrs I arrested GRIST.  I then observed a fuse laying in the ground outside the
driver's door and that the rear view mirror had been disconnected.  I took pictures and
places the fuse in the console.  This report forms my notes.
5.  This concludes my involvement in this investigation.

Police Witness Statement
 
INVESTIGATIONS:
 
1) On 19July20 I was working in a plainclothes capacity operating a discreet vehicle as a
member of the Southeast Special Projects Team.
 
2) At 0650 hrs I was informed by Cst. WEAVELL that there was an outstanding call for a
stolen vehicle equipped with GPS tracking and was currently pinging in Southeast Division.
 
3) Information on the call was that a 2019 Jeep Wrangler Sahara had been stolen overnight
and was currently pinging on Lee Ridge Road East of 71 st.
 
4) I attended the location and located the vehicle parked in visitor parking at 430 Lee Ridge
Road. I confirmed the VIN and surveillance was established.
 
5) At 1015 hrs I observed a male carrying two backpacks and a female walking toward the
vehicle. The female stayed behind and I observed the male unlock the vehicle and enter the
passenger seat.
 
6) Surveillance was maintained and the vehicle was followed to 116 st and 103 ave where the
occupants were arrested.

Police Witness Statement
 
INVESTIGATIONS:
 
1.    On 19JUL20, I (Cst. WEAVELL) was working in a covert surveillance capacity with the
Southeast Division Special Projects Team (SESPT).
 
2.    At 0700hrs, the SESPT attended the area of Lee Ridge Road west of 66 Street for a
Theft of Motor Vehicle complaint. A 2019 Jeep Wrangler that had been stolen bearing Alberta
plate BFC9811 earlier that morning had been GPS tracked to the area. The vehicle was
located parked in a parking lot and Reg. #3415 Cst. PATTEN verified the VIN was that of the
stolen vehicle. Cst. PATTEN noted the plate bearing on the vehicle was a dealer plate
M64303 Alberta.
 
3.    I contacted the complainant/owner of the stolen vehicle Miranda KILPATRICK who told
me the following details:
 
­Another vehicle had been broken into the previous day at the Superstore at 137 Avenue and
her purse was stolen
­In the purse were the keys for the Jeep, keys for their Ford truck, a Microsoft Surface tablet,
sunglasses
­She was unable to go back in the tracking history to determine when the vehicle was stolen
 
4.    At 1024hrs, the stolen Jeep rolled after Cst. PATTEN observed a female get into the
driver's seat (later learned to be Shannon KERR) and a male get into the passenger's seat
(later learned to be Wesley GRIST). Surveillance was maintained on the vehicle until it
parked on the east side of the alley just north of 103 Avenue, west of 116 Street. I
observed GRIST opening the hood of the vehicle and the KERR remained in the driver's seat
of the vehicle. I walked by the vehicle (at this point I was not identifiable as a Police Officer)
and when I did so, GRIST moved back towards the passenger seat and looked at me
(seemingly concerned of my presence).
 
5.    Eventually, at approximately 1115hrs Reg. #3383 Cst. MACDIARMID arrested GRIST as
he was standing at the hood of the stolen vehicle. Canine used their vehicle to block the rear
of the stolen vehicle and I approached from the driver's side, identified myself as "Police" and
drew my pistol to the low­ready position. I ordered KERR to exit the vehicle and handcuffed
her without issue and informed her she was under arrest for Theft of Motor Vehicle. I drew my
pistol to the low­ready position for the following reasons:
 
­KERR was in the driver's seat of a stolen vehicle and from my experience, driver's of stolen
vehicles are a high flight risk
­The vehicle could be used as a weapon and if she quickly backed up, may have struck Cst.

­I did not have access to any intermediate weapons such as a CEW, OC spray or a baton
 
6.    After a post­arrest search and once the scene was secure, at 1123hrs I advised KERR
she was under arrest for Theft of Motor Vehicle, a Form 21 Warrant and for Theft (of the
purse, however, she was not charge with it). When read her Charter Rights and asked if she
understood, she said, "Yes" and when asked if she wanted to speak to a lawyer, she said,
"Sure." When read the Caution Advisory and asked if she understood, she said, "Yes." When
advised she was under arrest for the theft of the purse, she said, "Someone else stole the
purse and gave me the keys!" At 1127hrs, I also advised KERR she was under arrest for
Theft for the license plate on the Jeep.
 
7.    At 1128hrs, KERR said (without me asked her), "You aren't gonna look at the Superstore
cameras?" It should be noted, no Police member ever told her the purse was stolen from
Superstore.
 
8.    At 1139hrs, I gave the complainant KILPATRICK her vehicle and keys back.
 
9.    KILPATRICK noted to me that there were papers missing from her vehicle that had her
Social Insurance Number on it.
 
10.    After speaking to the owner of the license plate M64303 which was Toyota on the Trail,
it was determined the license plate had been loaned to Vishal SHARMA who was driving a
loaner car Ford Flex. I spoke to SHARMA and attended his residence and obtained a written
statement from him. SHARMA said he had last confirmed the plate on the car at 1810hrs on
19JUL20 when it was parked at his work by 93 Street and 33 Avenue. SHARMA noticed the
plate missing at 0018hrs on 19JUL21 when his car was parked at 50 Street and 4 Avenue SW
and reported it Toyota as missing when the dealer opened in the morning. Toyota then
reported the plate as stolen to EPS.
 
11.    At 1414hrs, I attended Toyota on the Trail and returned the license plate. I obtained a
Solemn Declaration and written statement from employee Brittany BOOS. At 1541hrs, I
submitted the Solemn Declaration into Southeast Division exhibit locker number six.
 
12.    My involvement in this file is concluded.
