Direct Examination

PUBLIC PROS: May we proceed your honor?

JUDGE: Alright, you may proceeed.

PUBLIC PROS: Your Honor, we offer the testimony of the complainant Jerson Mabanding to
prove his ownership of the dump truck and amount of actual damages.

DEFENSE COUNS: Your Honor, we move to strike out certain portions of the judicial affidavit for
being hearsay, particularly paragraphs 7, 11, and 12 Your Honor.

PUBLIC PROS: Your Honor…

JUDGE: Sustained. Let paragraphs 7, 11, and 12 of the judicial affidavit be stricken out
from the records. [bangs gavel]

PUBLIC PROS: Mr. Mabanding, in what language would you like your testimony to proceed?

Maria O. Turo to prove that the accused Jojie Bogie and Jonie Tango threw
stones at the white dump truck with plate no. YMC 160 resulting to the damage
of its windshields.

I would like to call to the witness stand Mr. Bitao.

DEFENSE COUNSEL: Mr. Bitao, in Par. 8 of your joint judicial affidavit, you positively identified that it
was Jojie Bogie and Jonie Tango who threw the stones at the truck that you
were driving. Are you sure that it was really them?

INTERPRETER: Mr. Bitao, sai ka-walo na paragraph saimong joint judicial affidavit, imong
positibo nga gi-ila na sina Jojie Bogie og Jonie Tango ang maoy naglabay sa bato
na naka-igo sa imong trak na gidrayban. Sigurado ka ba nga sila gyud to?

BITAO: Nakahibalo ko na sila to sir kay nakita gud nako pag-aksyon nila ug labay.

INTERPRETER: I know that it was them because I saw them in the act of throwing.

DEFENSE COUNSEL: You said under Par. 10 that they were in the opposite side of the road. How
could you recognize their faces even when you were driving at around 7 o’clock
in the evening?

INTERPRETER: Imong nahisgot sa ikanapulo na paragraph na tua sila sa pikas nga parte sa
dalan. Giunsa nimo pag-ila sa ilang dagway na sila diay to na alas-syete naman
sa gabie og ikaw naga drive?

BITAO: Maklaro man sir kay naa man poste sa suga. Mao pud ingon sa kapitan na akong
nakaistorya.

INTERPRETER: It was clear because of the light post sir. At the same time, it was what the
(barangay) captain told me.

DEFENSE COUNSEL: You mean to say that the barangay captain told you that it was Bogie and Tango
who threw the stones at the truck?

INTERPRETER: Imong pasabot na ang barangay kapitan ang maoy nagsulti sa imo na mao si
Bogie ug Tango ang naglabay ug bato sa trak?

BITAO: Ani man gudna sir ha, wa man ko kaila sa ngalan gud nila sir kay nilabay ra man
mi didtoa. Mao tong gipapangutana nako sa taga-didto kung kinsa tong mga
tawhana, mao to pag-istorya nako sa taga-didto, maoy ingon nila na si Bogie ug
Tango maoy sad-an.

INTERPRETER: This is what happened sir, I really don’t know their names sir since we only
passed there. That is why I asked from the residents who were those people,and
they said it was Bogie and Tango who were at fault.

DEFENSE COUNSEL: Mr. Bitao, can you estimate how far was the opposite side of the road from the
road where your truck was hit?

INTERPRETER: Mr. Bitao, imo bang ma-estima kung unsa kalayo ang pikas nga parte sa dalan
gikan sa dalan kung asa na igo ang trak?

BITAO: Mga quinse ka metros guro sir.

INTERPRETER: Around fifteen meters sir.

DEFENSE COUNSEL: Was it not difficult or impossible for you to actually see the faces of Bogie and
Tango given the distance of 15 meters, and that it was 7 o’clock in the evening,
and you were the one driving?

INTERPRETER: Dili ba na lisod or imposible na makita nimo ang nawong ni Bogie og Tango sa
distansya nga kinse metros, og nahitabo kini sa alas syete sa gabii, ug ikaw ang
naga maneho?

BITAO: Maklaro ra man sir.

INTERPRETER: It was clear sir.

Mr. Bitao have you seen light posts along the road that you were traversing
particularly near the residential area of Barangay Sitio Rivas, Talomo?

DEFENSE: Objection Your Honor, Leading.

PUBLIC PROSECUTOR: Your honor, we are already in re-direct.

JUDGE: Overruled. Interpreter, kindly translate the last question.

INTERPRETER: Mr. Bitao, kakita ba ka ug mga poste sa suga sa dalan nga imong giagian labi na
duol sa mga balay-balay sa Barangay Sitio Rivas, Talomo?

PUBLIC PROS: In the area where the truck that you were driving was hit, can you estimate how
many are the light posts?

INTERPRETER: Satungod kung asa imong trak nalabayan, ma-estima nimo unsa kadaghanan ga
mga poste sasuga?

BITAO: Lisod man i-estima Ma’am, kanang normal lang gud kadaghan na naa sa
highway.

INTERPRETER: It is difficult to estimate Ma’am maybe the usual number of posts found in a
highway.

saw “several persons” throwing stones. Is that correct?

DEFENSE: How could you say that it was Bogie and Tango who threw the stones that hit
the windshields when in fact you admitted on the same paragraph that you did
not actually see the persons who threw the stone?

resulta sa pagka buak sa imong windshield nga imo namang giangkon sa imong
salysay na wala man ka kakita kung kinsa jud nilabay sa bato?

INTERPRETER: I saw both of them in the opposite side of the road throwing stones. Others who
were nearby, were also throwing stones.

DEFENSE LAWYER: Can you identify these “other persons” that you are referring to?

INTERPRETER: Imo bang masulti kung kinsa ning laing tao na imong ginapasabot?

TURO: Naa man gud mga tao sa unahan sir na kapareha nila gadagan ug naay bitbit na

INTERPRETER: There were other people near the area that were running and carrying stones.
