PETITION FOR RESTITUTION OF CONJUGAL RIGHTS


UNDER SECTION 9 OF THE HINDU MARRIAGE ACT,
1955

The petitioner respectfully submits as under:

1. That marriage of the petitioner and the respondent was


solemnized on 26/6/2020 at Arya Samaz Mandir,
Tikrapara, Raipur, C.G. Copy of marriage certificate is
enclosed herewith.
2. That, soon after the marriage, respondent started forcing
the petitioner to separate from his parents and forced
him to threat his parents for money. It is worth to
mention herein that respondent forced the petitioner to
live in separate rented house despite knowing full well
that he is dependent on his parents for all his needs.

3. That, the respondent used abusive language for the


parents of the petitioner due to which parents of the
petitioner broke all the relations with the Petitioner and
dispossessed him from all their acquired property.

4. That, on 27/8/2020 respondent left the place of


petitioner all with his belongings including cash and
kinds and left to her parental house at Raigarh.
Petitioner and was petitioner is a permanent resident of
Raipur, Chhattisgarh and is only son and care taker of
his old parents at Raipur.

5. That, the Petitioner has been staying all alone since


27/8/2020 being deprived from his conjugal rights and
had called the respondent and her parents on various
occasions but they are not heeding towards the problem
faced by the Petitioner.

6. That, whenever Petitioner calls the respondent he is


intimidated with abusive language which has caused
serious mental trauma to Petitioner.

7. That, Petitioner has lost his business/job due to social


stigma and wilful infliction of emotional distress by
respondent.
8. That, in past eighteen months petitioner has tried all the
possible ways to bring his wife to Raipur but all his
attempts have failed.

9. That the petition is not being presented in collusion with


the respondent.

10. That this petition is being presented without any


unnecessary or improper delay on the part of the
petitioner.

11. That there is no other legal ground as to why the


decree of restitution of conjugal rights be not granted in
favor of the petitioner.

12. That this Hon’ble Court has jurisdiction to entertain


and try this petition as the marriage was solemnized at
Raipur and both Petitioner and Respondent stayed at
Raipur before the respondent left the company of
petitioner.

Prayer

In view of aforesaid the petitioner therefore prays for grant of


decree for restitution of conjugal rights in his favor and against
the respondent.

AFFIDAVIT OF PETITIONER

I, Prem Hablani, Aged 29 Years, S/o shri Sarbanand Hablani, R/o


Shivanand Nagar, Shrinagar, Gudhiyari, Raipur , do hereby take an
oath and state that the contents of the accompanying petition in said
paragraphs 1 to 12 of the petition are drafted by my counsel as per my
instruction and explained to me in vernacular, which I admit to be true
and correct. I say that, the contents of the above said paragraphs of the
plaint are true and correct as per my knowledge and information, Hence,
this affidavit.
