COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS THAT:

This Compromise Agreement done and executed by and between the


parties:

XXX, of legal age, with postal address at (address),


hereinafter referred to as the “FIRST PARTY;”

-and-

YYYY, both of legal age and with office address (address),


hereinafter referred to as the “SECOND PARTY.”

Hereinafter called “the PARTIES”.

WITNESSETH THAT:

WHEREAS, the FIRST PARTY is the private complainant in Criminal


Case No. R123456-CR entitled People vs. YYY, for Estafa under Article 315
par. 2 (a) before the Regional Trial Court, while the SECOND PARTY is the
defendant in the said case.

WHEREAS, the parties desire to buy peace and wish to avoid a protacted
litigation in this case.

NOW THEREFORE, for and in consideration of the foregoing and the


further covenants hereinafter set forth, the parties agree as follows:

I. The SECOND PARTY shall pay the FIRST PARTY the amount of
Twenty Million Pesos (Php P20,000,000.00) in the following manner:

a. Upon signing of this Compromise Agreement, the amount of


Three Hundred Thousand Pesos (Php P 300,000.00) to paid in
cash representing the August 15, 2022 and September 15, 2022
monthly payment:

b. Upon signing of this Compromise Agreement, for the purpose


of the monthly payment, the SECOND PARTY shall issue in favor of the
FIRST PARTY thirty four (34) postdated checks in the amount of One
Hundred Fifty Thousand Pesos (Php P150,000.00) per check dated
every 15th day of each month starting October 15, 2022 covering the
period of three (3) years from the signing of this Compromise
Agreement; and

c. That the SECOND PARTY shall also, upon signing of this


Compromise Agreement, issue in favor of the FIRST PARTY a post-
dated check dated August 15, 2025 in the amount of Fourteen
Million Pesos (Php P14,000,000.00)
II. That upon compliance of the SECOND PARTY of the conditions
stated under paragraph 1 stated above, the Parties shall seek the approval of
the Compromise Agreement by the Metropolitan Trial Court, Branch 2, Manila
and cause the case to be archived until the SECOND PARTY has paid in full his
total obligation Twenty Million Pesos (Php P20,000,000.00).

III. This Compromise Agreement shall be binding on any and all of the
PARTIES’ heirs, assigns, and successors- in- interest.

IV. In case the SECOND PARTY failed to comply with the above
mentioned undertaking, the FIRST PARTY is entitled to the issuance of a writ of
execution; and

V. The FIRST PARTY undertook to execute an Affidavit of Desistance


to have the criminal aspect of the case mentioned above dismissed should the
SECOND PARTY complied with the above undertaking.

VI. The respective counsels of the parties hereby undertake to


guarantee faithful and sincere observance and compliance with this Agreement.

IN WITNESS WHEREOF, the parties hereby affix their signatures this

This Compromise Agreement, consisting of three (3) including this page


on which the acknowledgment is written is signed by the parties and their two
(2) material witnesses on each and every page thereof.
