Accused JUAN DELA CRUZ was convicted of violation of Section
12, Art. II of R.A. 9165 and was sentenced to suffer the penalty of TWO (2) YEARS and ONE (1) DAY to THREE (3) YEARS imprisonment for Criminal Case no. DU-35027 and ONE (1) YEAR and ONE (1) day to TWO (2) YEARS for Criminal Case no. DU-35028, per Judgment of the Court dated April 12, 2019.
On April 22, 2019, accused filed an Application for Probation which
was referred to the Cebu City Parole and Probation Office for investigation per Order dated May 2, 2019. On January 2, 2020, the Cebu City Parole and Probation Office submitted a Post-Sentence Investigation Report recommending the approval of the said application for probation.
WHEREFORE, finding merit in the application for probation of
accused JUAN DELA CRUZ, and taking into consideration the recommendation of the Cebu City Parole and Probation Office, the same is hereby GRANTED and the execution of his sentence is suspended, subject to the following terms and conditions:
1. That he shall undergo probation period of FIVE (5) YEARS to
be counted from his initial reporting for supervision;
2. He shall report initially to the Chief Probation and Parole Officer
at Cebu City Parole and Probation Office, Hall of Justice, Cebu City within Seventy-Two (72) from receipt of the order granting probation;
3. He shall, thereafter, report to his supervising officer at least
once a month, unless otherwise modified by the Chief Probation and Parole Officer;
4. He shall reside at Sitio Mabuhay, Brgy. Poblacion, Cebu City,
Cebu and shall not change his residence without prior approval of the Chief Probation and Parole Officer or of the Court as the case may be; 5. He shall secure a written permit to travel outside the jurisdiction of the Cebu City Parole and Probation Office from the Chief Probation and Parole Officer, or from the Court if such travel exceeds thirty (30) days;
6. He shall not commit any crime or any other offense;
7. He shall render one hundred twenty (120) hours of Community
Work Service (CWS) and will participate in tree-planting activities;
8. He shall allow his Supervising Probation and Parole Officer or
an authorized Volunteer Probation Assistant to visit his home and place of work;
9. He shall meet his family responsibilities;
10. He shall undergo random drug test, medical, psychological or
psychiatric examination and treatment and enter and remain in a specified institution, when required for that purpose;
11. He shall actively participate the Therapeutic Community
Ladderized Program (TCLP) in the entire duration of his probation period;
12. He shall devote himself to a specific employment and shall not
change said employment without prior notice to the supervising officer and/or pursue a prescribed secular study or vocational training;
13. He shall refrain from associating with persons of questionable
character;
14. He shall cooperate with his program of supervision, and shall
satisfy any other condition related to his rehabilitation and not unduly restrictive of his liberty or incompatible with his freedom of conscience.
In the event that petitioner fails to observe the preceding
conditions and/or has committed any material misrepresentation in his application for probation, his probation may be revoked by the Court or the conditions thereof modified.
SO ORDERED.
