Introduction
Computerization has revolutionized the
handling and processing of information to
such an extent that the data itself has now
become a commodity which possesses
commercial value.
The value to business is also enhanced by the
fact that data can be transferred around the
globe with great ease.
Introduction
In any event, given the massive total of online
information available, this still gives rise to fear
of the abuse and misuse of data which could
involve invasions of privacy, use of the data for
unauthorized and unexpected purposes and so
on.
Where false information is communicated
about a person this could also lead to the
possibility of an action in defamation.
Data protection and Privacy
The council of Europe convention whose
declared object is to strengthen data protection
then sets out in article 1 that the purpose of the
convention is to secure the right to privacy with
regard to automatic processing of data.
More recently article 1 of the Data protection
Directive 1995 sets out the objective of the
directive as being to protect [the] right to
privacy.
