Agreement to Terms

These Terms of Service ("Terms") govern your use of the Satiro mobile application and website at satiro.app (collectively, the "Service") operated by element.fm ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Description of Service

Satiro is a Podcasting 2.0 podcast player application that includes:

• Podcast discovery, streaming, and downloading
• A non-custodial Bitcoin wallet for Lightning Network payments
• Value-for-value streaming payments to podcast creators
• Playlist and favorites management
• Offline listening capabilities

Bitcoin Wallet Terms

Non-Custodial Nature

The Bitcoin wallet integrated into Satiro is non-custodial. This means:

• You have sole control over your private keys and funds
• We do not store, access, or control your Bitcoin in any way
• We cannot reverse, cancel, or refund any transactions
• We cannot recover lost or stolen funds
• We cannot recover lost seed phrases or private keys

Your Responsibilities

• Securely backup your wallet seed phrase
• Keep your device secure and updated
• Verify all transaction details before confirming
• Understand the risks of cryptocurrency transactions
• Comply with all applicable laws regarding cryptocurrency in your jurisdiction

Transaction Finality

Bitcoin and Lightning Network transactions are irreversible. Once a payment is sent, it cannot be reversed or refunded. You acknowledge that you send payments at your own risk and that we bear no responsibility for misdirected or unintended payments.

No Financial Advice

Nothing in our Service constitutes financial, investment, legal, or tax advice. Cryptocurrency values are volatile and you may lose some or all of your funds. Consult appropriate professionals before making financial decisions.

Podcast Content

Satiro provides access to third-party podcast content. We do not create, control, or endorse the content of podcasts available through our Service.

• Podcast creators are solely responsible for their content
• We are not liable for any content you access through the app
• Copyright and intellectual property rights belong to respective content owners
• Payments made to podcast creators are between you and the creator

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer or attempt to extract source code
• Use the Service to transmit malware or malicious code
• Use the Service for money laundering or other financial crimes
• Violate any applicable laws or regulations

Intellectual Property

The Service and its original content, features, and functionality are owned by element.fm and are protected by international copyright, trademark, and other intellectual property laws.

The Satiro name, logo, and related trademarks are the property of element.fm. You may not use these marks without prior written permission.

Disclaimer of Warranties

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• The results of using the Service will meet your requirements

Limitation of Liability

• Your access to or use of (or inability to use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Loss of cryptocurrency or wallet access
• Failed, delayed, or misdirected transactions

Indemnification

You agree to defend, indemnify, and hold harmless element.fm and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. Your wallet and any Bitcoin stored therein remain under your control, as we have no access to your funds.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be notified with at least 30 days notice before new terms take effect. Your continued use of the Service after changes constitutes acceptance of the new Terms.
