BOOT.DEV TERMS AND CONDITIONS OF USE
Ogdolo LLC, dba Boot.dev (“Boot.dev”), whose principal office is located at 3520 N. University Ave., Suite 300, Provo, UT 84604, owns and operates www.boot.dev (the “Site”), providing access to digital information and educational content related to learning backend development (our “Service”).
Access to and use of the Site and the Service is provided by Boot.dev (“we”, “us”, and/or “our”) subject to the following terms and conditions (the “Terms”).

You represent that you are over the age of 18. We do not permit those under 18 to use the Site.
You acknowledge that Boot.dev is the sole owner (or the licensee) of all content on the Site, including, without limitation, all applicable copyrights, patents, trademarks, trade secrets, logos, and other intellectual property rights, as well as all text, images, graphics, logos, audio, video, URLs, metadata and other material appearing on the Site (the “Boot.dev Content”). The Site and the Boot.dev Content are protected by the copyright and intellectual property laws of the United States and are protected globally by similar laws and applicable international copyright treaties.
You agree that your use of the Site and Boot.dev Content is for your own personal and non-commercial use only. Without limitation, you shall not use (and you agree not to assist or allow anyone else to use) the Site and/or any Boot.dev Content for any other purpose without our prior written approval. In the event of such a breach, your right to use this Site will cease immediately.

6. Indemnification.
You agree to indemnify, defend and hold harmless Boot.dev and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of any of these or your violation of any law or the rights of a third-party.
7. No Warranties.
The Service is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind.
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, BOOT.DEV EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE SERVICE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OR TRADE PRACTICE. WITHOUT LIMITATION TO THE FOREGOING, BOOT.DEV PROVIDES NO WARRANTY OR UNDERTAKING, AND MAKES NO REPRESENTATION OF ANY KIND THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE OR WORK WITH ANY OTHER SOFTWARE, APPLICATIONS, SYSTEMS OR SERVICES, OPERATE WITHOUT INTERRUPTION, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS OR BE ERROR FREE OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

IN NO CASE SHALL BOOT.DEV, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SITE OR THE SERVICE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SITE OR THE SERVICE, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Boot.dev. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Boot.dev shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

10. Severability.
In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, the unenforceable portion shall be deemed to be severed from these Terms, and such determination shall not affect the validity and enforceability of any other remaining provisions.
11. No Waiver.
Our failure to insist upon or enforce any provision of these terms of service shall not be construed as a waiver of any provision or right of Boot.dev.
12. Governing Law:
These terms and conditions are governed by the laws of the United States of America and the laws of the State of Utah. You agree that exclusive jurisdiction for any claim or dispute with Boot.dev or relating in any way to your use of the Site will be in the courts of Utah County, State of Utah, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah County, State of Utah, in connection with any such dispute and including any claim involving Boot.dev or its affiliates, subsidiaries, employees, contractors, officers, and directors.
13. Entire Agreement.
These Terms and any policies or operating rules posted by us on this Site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Site and Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).
