A Melbourne mum is suing the AFL and Ethiad Stadium after claiming she was injured when she was allegedly hit in the head by a football three years ago.

Jodie Burns claims she was rushed to hospital with spinal and neck injuries after she was allegedly struck by a Sherrin while lining up for tickets outside the venue to watch Carlton and GWS play in May 2015, the Herald Sun reported. 

The mother-of-three claims in court documents that the conduct of the AFL and Melbourne Stadiums was negligent and 'below a reasonable standard of care', the publication reported.

This was despite signs around the stadium asking patrons to not kick footballs.

Ms Burns claims she spent three days in Royal Melbourne Hospital and was allegedly rushed back to hospital eight hours later when she began vomiting and her speech was affected.

'It's something that should not have happened,' Ms Burns told the Herald Sun at the time.

'They should not have been kicking the football.'

Ms Burns is a full-time carer for her intellectually disabled son Brock.

'If it had hit my son, Brock, it would have killed him,' she told the Herald Sun at the time.

An AFL spokesman told Daily Mail Australia that the AFL had not yet received any details regarding the reported legal action and wouldn't provide any further comment. 

An Ethiad Stadium spokesperson was unavailable for comment on Wednesday night.
