Airbnb is suing a booking guest for the first time after they rented a California home to host a huge party where three people ended up being shot

Airbnb says it is suing a booking guest for the first time after the person held a huge party at a California home at the weekend that ended with three people being shot. 

The short-term home rental company is pursuing legal claims and damages against the guest who booked and hosted an unauthorized party at a home in Sacramento County. 

The Sacramento County Sheriff's Office said three people were shot at the party on Sunday at about 1.15am. 

The three victims were all rushed to a nearby hospital where they remain in a stable condition.

Officers are still searching for the gunman and there is no known motive at this time.  

The party was crowded and was mostly people in their early 20s, officers said. 

The majority of guests scattered after the gunshots rang out.  

After learning about the party, Airbnb removed the booking guest from the platform. 

The unidentified guest was also notified on Monday of the pending legal action.

'This marks the first time Airbnb has taken affirmative steps to initiate legal proceedings against a booking guest for throwing an unauthorized party,' an Airbnb spokesman said. 

Airbnb said the legal action was a result of negligence and violation of local health orders related to the COVID-19 pandemic.

The guest also violated Airbnb's Community Standards and made the reservation under false pretenses, Airbnb says.

The company said that in addition to supporting the host, they would donate any money recovered through legal proceedings to a local Sacramento non-profit fighting against gun violence. 

The pending legal actions come in the same week it was revealed Airbnb plans to confidentially file for an initial public offering this month. 

Sources said the short-term home rental company was close to confidentially filing paperwork for an IPO with the US Securities and Exchange Commission later in August. 

Airbnb is preparing to potentially go public before the end of the year, the Wall Street Journal reported on Tuesday, citing sources familiar with the matter. 

The company's founder estimated this week that they have lost $1 billion during the COVID-19 pandemic. 

CEO and co-founder Brian Chesky said the short-term home rental company lost the staggering amount due to the refunds that had to be issued because of the global travel shutdowns that have occurred as a result of the pandemic.
